Price Match Guarantee Terms (ResMed Brand Products Only)

1. Availability of offer

CPAP Australia’s Price Match Guarantee will only match a lower advertised price for ResMed brand products only. The CPAP Australia Price Match Guarantee is only available via Live Chat or CCC(1300 69 2727) upon providing proof of a lower advertised price (subject to the exclusions and conditions outlined in these terms). CPAP Australia reserves the right to impose purchase limits on the CPAP Australia Price Match Guarantee.

Lower advertised price
A lower advertised price means a print or online advertisement, or physical or digital catalogue stating a price in Australian Dollars below the price advertised by CPAP Australia on the same date.

Exclusions

The CPAP Australia Price Match Guarantee does not apply to a lower advertised price that:

• is part of a bundle;
• is part of a bonus, gift card, coupon, cashback or financing offer;
• is a pricing error;
• relates to pricing for the commercial or wholesale supply of a product (even if the product is a qualifying ResMed product); or
• is not available to the general public, including if the offer is for trade, special events, clubs or where the offer is not accessible without a membership.

Proof of a lower advertised price

To avail the CPAP Australia Price Match Guarantee you must provide proof of a lower advertised price to CPAP Australia and available at time of purchase.

Proof of a lower advertised price must:

• clearly state the lower advertised price, as well as any conditions applicable to the price, and be inclusive of any delivery and handling charges;
• be verifiable by CPAP Australia; and
• apply to a product that is identical to a qualifying ResMed product. The product must be in stock at the authorised ResMed dealer and the stock must not require delivery to or from a location outside Australia.

2. Eligible competitors

CPAP Australia's Price Match Guarantee will only match a lower price advertised by an eligible competitor.

To be an eligible competitor the competitor must meet the following requirements:

• Must have at least one (1) physical store in Australia;
• Must be a registered Australian business with an Australian Business Number (ABN) and be registered for GST;
• Must be an authorised distributor of ResMed products.
• For the avoidance of doubt, sub-authorised distributors are not an eligible competitor for the purposes of the Price Match Guarantee; and
• Must not be eBay, an online or physical marketplace (including but not limited to Amazon, Catch, Kogan, Gumtree and auction houses), and a clearance or warehouse outlet.

3. To which products does the Price Match Guarantee apply?

The CPAP Australia Price Match Guarantee applies to qualifying ResMed products only. To be a qualifying ResMed product, the product must be a device that is currently available for sale through CPAP Australia's website (cpapaustralia.com.au/resmed), subject to any exceptions outlined below. This may include a device, mask, accessories, and cleaning accessories. The CPAP Australia Match Guarantee does not apply to clearance, second-hand, liquidation, refurbished and/or demo products.

Exceptions

The following products and services are not qualifying ResMed products:

• Subscription Plans;
• Therapy Plans;
• Rental or trial devices; or
• Sleep health products.
